This Privacy Policy explains how Chainbull Inc., a Texas corporation located in Austin, Texas ("BrandWyre", "we", "us"), collects, uses, discloses, and safeguards your information when you visit brandwyre.com or use our press release writing, distribution, and syndication services (the "Services"). It is designed to comply with applicable U.S. federal and state privacy laws, including the California Consumer Privacy Act, as amended by the CPRA ("CCPA/CPRA"), the Children's Online Privacy Protection Act ("COPPA"), the CAN-SPAM Act, the Telephone Consumer Protection Act ("TCPA"), and similar state privacy laws (e.g., Virginia VCDPA, Colorado CPA, Connecticut CTDPA, Utah UCPA, Texas TDPSA).
1. Information We Collect
- Information you provide: name, business name, email, phone number, billing address, content you submit for publication (drafts, quotes, logos, images), support messages, and any account credentials.
- Payment information: processed by our PCI-DSS compliant payment processor (Stripe). We do not store full card numbers; we receive transaction metadata only.
- Automatic data: IP address, device type, browser type, referring URL, pages visited, time spent, and similar diagnostic information collected via cookies and similar technologies (Meta Pixel, analytics).
- Email engagement: opens, clicks, and bounce data via our email vendor (Loops).
2. How We Use Information
- To deliver, schedule, and publish your press release campaign.
- To process payments, prevent fraud, and maintain accounting records.
- To respond to support requests and send transactional emails (order confirmations, status updates, invoices).
- To send marketing emails about related Services (you may opt out at any time per the CAN-SPAM Act using the unsubscribe link).
- To measure advertising performance using Meta Conversions API and similar tools.
- To comply with legal obligations, enforce our Terms, and protect our rights.
3. How We Share Information (Sub-processors)
We share information only as described below; we do not sell personal information for money. The following sub-processors receive personal data strictly to provide their services to us:
- Partner Outlets & distribution networks — submitted content, byline, and contact details necessary to publish your press release.
- Stripe, Inc. — payment processing, fraud screening, tax records.
- Loops — transactional and marketing email delivery, engagement metrics.
- Supabase / Lovable Cloud — database hosting and authentication.
- Slack Technologies, LLC — internal operational notifications (order events, support tickets, lead alerts). Slack receives order metadata (order number, email, package, totals) for our team's workflow only; it is not used for marketing.
- Meta Platforms, Inc. and analytics providers — advertising measurement via Meta Pixel and Conversions API; hashed identifiers are sent server-side for conversion attribution.
- Legal & safety — to comply with subpoenas, court orders, or other legal process; to investigate fraud or violations of our Terms.
- Business transfers — in connection with a merger, acquisition, or sale of assets, subject to standard confidentiality.
Each processor is bound by a written agreement limiting use of personal data to the service provided to us, consistent with CCPA/CPRA "service provider" requirements and analogous state privacy laws.
We use advertising cookies and pixels (e.g., Meta Pixel) that may constitute "sharing" or "targeted advertising" under certain state privacy laws. You can opt out as described in Section 6.
3a. Data Processing Addendum (B2B / International)
For business customers whose use of the Services involves personal data of EU/UK/EEA data subjects (e.g., European or Asia-Pacific distribution packages), a Data Processing Addendum ("DPA") incorporating Standard Contractual Clauses is available on request by emailing primal@brandwyre.com. Where Chainbull Inc. acts as a processor on behalf of a business customer, the DPA governs that processing.
4. Cookies, Consent Banner & Tracking
We use strictly necessary cookies (login/session), analytics cookies, and advertising cookies (Meta Pixel + Conversions API). Where required by your state or country of residence, a cookie consent banner is presented on first visit to obtain or refuse consent for non-essential cookies. You can change your choice at any time by clearing site data or by emailing us. We also honor the browser-based Global Privacy Control ("GPC") signal as a valid opt-out of targeted advertising and "sale"/"sharing" for residents of states where GPC is legally recognized (e.g., California, Colorado, Connecticut).
4a. Texas TDPSA Notice
For Texas residents: the Texas Data Privacy and Security Act ("TDPSA") applies regardless of revenue thresholds. Chainbull Inc. does not "sell" personal data in exchange for monetary consideration. To the extent any sharing of personal data for targeted advertising occurs via cookies/pixels described above, you have the right to opt out. We do not process "sensitive data" (as defined by TDPSA) without obtaining your prior consent, and we do not knowingly process the data of known children. 5. Data Retention
We retain order, billing, and tax records for at least 7 years to comply with U.S. tax and accounting rules. Marketing data is retained until you unsubscribe. Support tickets are retained for up to 3 years. You may request earlier deletion subject to legal retention requirements.
6. Your U.S. Privacy Rights
Depending on your state of residence, you may have the right to:
- Know / access the personal information we hold about you.
- Request correction of inaccurate information.
- Request deletion (subject to legal exceptions such as tax records and fraud prevention).
- Opt out of targeted advertising, "sale" or "sharing", and profiling that produces legal or similarly significant effects.
- Receive a portable copy of your data.
- Appeal a denial of a privacy request.
- Be free from retaliation for exercising your rights.
To exercise these rights, email primal@brandwyre.com. We will verify your identity (typically by confirming order email and a recent order number) and respond within the time required by applicable law (generally 45 days, extendable once). You may designate an authorized agent in writing.
7. Children's Privacy (COPPA)
The Services are intended for businesses and adults 18+. We do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it.
8. Email & SMS Communications
Transactional emails (order confirmations, invoices, expiry reminders, support replies) are sent as part of the Services and are not subject to unsubscribe. Marketing emails include an unsubscribe link as required by the CAN-SPAM Act. If we send SMS, it is on an opt-in basis with STOP-to-cancel support, consistent with the TCPA.
9. Data Security
We use industry-standard security including TLS encryption in transit, encrypted storage, role-based access controls, and audit logging. No system is 100% secure; you submit information at your own risk and should not transmit highly sensitive data (e.g., Social Security numbers, health information) to us — we do not need it.
10. International Users
BrandWyre is operated by Chainbull Inc. and based in Austin, Texas, United States. Data is processed in the U.S. If you access the Services from outside the U.S., you consent to the transfer and processing of your information in the U.S., which may have different data-protection laws than your country.
11. Changes to this Policy
We may update this Policy from time to time. Material changes will be posted on this page with a new "Last updated" date and, where required, sent by email.
